JUSTICE SUDHIR SINGH ORAL ORDER 08-10-2018 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the O.P. No. 2. The petitioners are apprehending their arrest in a case registered under Sections 384, 504 and 427 of the Indian Penal Code.

The prosecution case, in short, is that on account of dispute over encroachment of public land, while the informant was working at his house, the accused persons variously armed entered into his house and demanded extortion money and when denied they threatened the informant.

It has been submitted on behalf of the petitioners that

Patna High Court Cr.Misc. No.58092 of 2018(2) dt.08-10-2018 2/2 the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. In paragraph 6 of the petition, the petitioner has stated that both the parties are agnates. Due to property dispute, the present complaint has been filed. A proceeding under Section 133 Cr.P.C. is also pending before the S.D.O., Patna City. Just to make the matter grievous, superficial allegations have been made in the present case.

On behalf of the State, it is submitted that the petitioners are named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City, Patna in connection with Patna City C.A. No. 520 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
