ANJANA MISHRA ORAL ORDER 08-10-2018 At the outset, learned counsel for the petitioner prays for correcting the name of the petitioner to be read as Jitendra Kumar @ Jitendra Rai, as per the F.I.R. of the present case. He submits that the said mistake has occurred on account of the fact that the name of Jitendra Kumar was recorded in the order rejecting the anticipatory bail application of the petitioner in the court below.

Let the name of Jitendra Kumar be read as Jitendra Kumar @ Jitendra Rai, son of Late Ishwari Rai. Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Danapur P.S. Case No.547 of 2017 for allegedly having committed the offence under Sections 147, 148, 149, 341, 323, 302 and 120B of the Indian Penal Code and

Patna High Court Cr.Misc. No.61751 of 2018 (2) dt.08-10-2018 2/2 Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he is one of the conspirators. He submits that save and excpt the conjecture that he was one of the conspirators, there is no further material against the petitioner to implicate him in connection with the present case. It is further submitted that other co-accused persons have since been granted the privilege of anticipatory bail in Cr.Misc. No.50514 of 2017, vide order dated 14.11.2017.

Considering the aforementioned facts and circumstance, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, in connection with Danapur P.S. Case No.547 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
