The petitioner is in custody in connection with Motihari Mufassil P.S. Case No.450 of 2018 for the offences under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioner is that he has miscalculated the account of Poshak and scholarship. Learned counsel for the petitioner submits that petitioner has made accused on account of miscalculation of the account in the matter of accounting and as such petitioner deserves bail. He further submits that there is no question of any defalcation and petitioner has paid the amount to the beneficiaries students and not even a single student has made

Considering the fact that matter relates to settlement of account, this Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Mufassil P.S. Case No.450 of 2018.
