The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 24 of 2020 registered under Sections 272, 273, 414 of the Indian Penal Code and section 30(A) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. On perusal of seizure list, it appears that nothing has been recovered from the possession of the petitioner. Further submission is that although the petitioner was not arrested on the spot but nothing has been recovered from his possession. Admittedly, the car from which the alleged recovery of wine was made does not belong to the petitioner.

No.31072 of 2020(2) dt.08-03-2021 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S. Case No. 24 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
