2. The present application has been filed for modification of the order dated 02.07.2025 passed in Cr. Misc. No. 6700 of 2025, whereby the provisional bail granted to the petitioner was confirmed, subject to certain conditions.

3. The learned counsel for the petitioner submits that the petitioner is a lady, having two minor children, who are presently pursuing their studies at Ryan International School, Goregaon (East), Mumbai and the husband of the petitioner is in judicial custody since 19.11.2024. It is further submitted that the petitioner is solely responsible for the care, upbringing and education of her minor children and according to condition no.

No.32976 of 2026(2) dt.08-05-2026 2/2 (i) the petitioner shall remain physically present in Court on each date of the trial, is causing extreme hardship and practically impossible for her to take care of her minor children and also pursuing in their education. Hence, the condition no. (i) out of four conditions, as referred in the order dated 02.07.2025, passed in Cr. Misc. No. 6700 of 2025, may be exempted.

4. Considering the facts and circumstances of the case, let condition no. (i) be deleted, out of four conditions, from the order dated 02.07.2025, passed in Cr. Misc. No. 6700 of 2025 and other three conditions which are condition nos. (ii) to (iv) shall remain intact.

5. Accordingly, the prayer for modification is allowed and the petition stands disposed of.
