The sole petitioner, who is in custody since 08.02.2019, as stated in paragraph-14 of the petition, has prayed for grant of bail in Kesariya P.S. Case No.61 of 2019, registered for offence under Sections 411, 414, 120B of the Indian Penal Code, 1860.

At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. It is also stated that the petitioner's name has come on the basis of confessional statement of co-accused, whereas looted motorcycles were recovered from the premises of co-

Patna High Court CR. MISC. No.30944 of 2019(2) dt.11-06-2019 2/2 accused, on whose confession the petitioner has been implicated. It has been emphatically argued that save and except the confessional statement, there is no other material against the petitioner.

Learned Addl. Public Prosecutor has opposed the prayer for bail.

However, considering the period of custody, clean antecedent of the petitioner as well as the fact that the petitioner's name has come in the confessional statement, let the petitioner, namely, Satya Prakash Kumar @ Tullu @ Tull is directed to be released on bail on furnishing bail-bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned learned 3rd Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Kesariya P.S. Case No.61 of 2019.
