JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-09-2018 This application has been filed for modification of the order dated 18.04.2018 passed in Cr.Misc.No.12053 of 2018 by extending the period of further four weeks to surrender of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that vide order dated 18.04.2018 passed in Cr.Misc.No.12053 of 2018 the petitioner was ordered to be released on bail, in the event of his arrest or surrender within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Modal) P.S. Case

Patna High Court Cr.Misc. No.59206 of 2018 (2) dt.26-09-2018 2/2 No.569 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. with further condition that petitioner will furnish bank guarantee of Rs.5,67,809/-. But unfortunately the petitioner fell seriously ill due to which he could not surrender before the learned court below within the stipulated time. For the reasons stated in the modification petition, the same is, accordingly, allowed.
