2. Petitioner seeks regular bail in connection with Kahalgaon (Ghogha) P. S. Case No. 809 of 2022 registered for the offences punishable under Sections 363, 365/34 of the Indian Penal Code to which Sections 302, 201 IPC were added later on.
3. As per prosecution case, this petitioner along with other F.I.R. named accused persons abducted the son of informant, namely, Niraj Kumar and neighbour of informant, namely, Govind Kumar and later on, dead body of the son of informant was recovered from the bank of River Ganga.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Informant
Patna High Court CR. MISC. No.31550 of 2026(2) dt.14-05-2026 2/2 is not an eye witness to the occurrence and petitioner has been made accused in this case only on suspicion. As per F.I.R., on the phone call of co-accused Kajal Devi, Niraj Kumar (deceased) left the house at about 10 PM and co-accused Kajal Devi has already been granted bail by co-ordinate Bench of this Court vide order dated 19.12.2023 passed in Cr. Appeal (SJ) No. 5348 of 2023. Petitioner claims clean antecedent and is in custody since 29.01.2026.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge-I, Bhagalpur in connection with Kahalgaon (Ghogha) P. S. Case No. 809 of 2022.
