JUSTICE SANDEEP KUMAR ORAL ORDER 03-08-2023 It has been submitted by the learned counsel for the petitioners that the parties have settled their dispute and pursuant to the settlement, a compromise petition has been filed in the Court of learned S.D.J.M., Patna on 14.03.2018 but because of non-appearance of the complainant, the case is pending. Learned counsel for the petitioners also submits that an application under Section 13B was filed on 31.02.2018 in the Court of learned Principal Judge, Family Court, Patna. After settlement of the dispute, the petitioners are being harassed because of the non-appearance of the opposite

Accordingly, this application is disposed of with a direction to the S.D.J.M., Patna to pass an order in accordance with law on the compromise petition within 15 days of receipt of a copy of this order. If the compromise petition is supported by the opposite party no.2 or if the opposite party doesn't appear in the Court of learned Magistrate, the proceedings against the accused persons shall be dropped. If the compromise petition is denied by the opposite party no.2, then the S.D.J.M., Patna will pass an order in accordance with law.

With the aforesaid observations and directions, this application is disposed of.
