====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 31-10-2018 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in connection with Pothiya P.S. Case No. 54 of 2017 registered for the offence punishable under sections 379 and 414/34 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Learned counsel appearing for the petitioner submits that merely on confessional statement of co-accused, petitioner has falsely been implicated in this case. No specific allegation has been levelled against this petitioner and nothing incriminating articles has been recovered from the conscious possession of the petitioner. Moreover, similarly situated coaccused has been granted bail by a Co-ordinate Bench of this Court vide order dated 23.07.2018 passed in Criminal Misc. No. 36126 of 2018.
Patna High Court Cr.Misc. No.59742 of 2018(2) dt.31-10-2018 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Pothiya P.S. Case No. 54 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
