2. In this case, the petitioner is seeking regular bail in connection with Hajipur Town P.S. Case No. 750 of 2019, registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code and Section 25(1-B)a/26 of the Arms Act.

3. As per allegation, on the basis of a secret information, the informant along with other police personnel reached at Kranti Chauk where on seeing the police, three persons started fleeing away. One of them was apprehended and disclosed the names of the petitioner and other co-accused. One country made pistol along with three live cartridges were recovered.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.35431 of 2024(3) dt.21-08-2024 2/2 that the petitioner is innocent and has falsely been implicated. Learned counsel has further submitted that the petitioner was not apprehended at the spot. Nothing was recovered from his possession and except confessional statement of co-accused, there is nothing against him. He is under custody since 01.06.2020.

5. On the other hand, the learned APP, Shri J.N. Thakur has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, especially, the fact that except confessional statement of the co-accused there is nothing against the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-XII, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 750 of 2019, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
