2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 407, 420/34 of the Indian Penal Code.
3. The prosecution case, as per F.I.R., is that the informant booked two trucks for transporting maize. It is further alleged that maize was loaded on the said trucks for delivery but the same was not delivered to the destination.
4. It is submitted that petitioner is not named in the F.I.R and his name transpired during course of investigation. Petitioner is neither driver nor owner of the trucks and he has got no concern with the trucks in question. Petitioner has got clean antecedent.
5. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.32285 of 2023(2) dt.25-07-2023 2/2 case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Khagaria in connection with Mansi P. S. Case No. 146 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
