JUSTICE SATYAVRAT VERMA ORAL ORDER 07-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Forbesganj (Simraha) P.S. Case No. 810 of 2020 instituted for the offences under Section 302 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 25.09.2020, charge-sheet has been submitted in the case and has antecedent of two cases under the Excise Act.

Learned counsel for the petitioner submits that the informant alleges that on 23.09.2020 when the informant came back home, his son (deceased) disclosed that he was scolding his wife when the petitioner came and assaulted him by a bamboo on his head causing injury and during the course of

Learned counsel for the petitioner submits that the petitioner has been falsely implicated by the informant. It is further submitted that deceased and his wife used to fight daily and it was the wife who, in rage, assaulted on the head of the deceased on account of which he suffered injuries and the petitioner came to be falsely implicated on account of land dispute.

At this stage, learned counsel for the petitioner seeks permission to withdraw the present bail application. Permission is accorded with liberty to the petitioner to renew his prayer for bail after framing of charges. Accordingly, the present bail application is dismissed as withdrawn.
