The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30 (a) and 37b of the Bihar Prohibition and Excise Act, 2016. From the house of these petitioners 2.7 litres of liquor was recovered and only person found in the house i.e. coaccused, Santosh Choudhary was arrested by the Police. Submission is that co-accused, Santosh Choudhary is not a family member of these petitioners. These petitioners have got no criminal antecedent.

Learned counsel for the informant opposed the prayer for anticipatory bail.

No.60823 of 2018(2) dt.03-10-2018 2/2 Considering the fact that there is no direct involvement of these petitioners for the purpose of consideration of prayer for anticipatory bail, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Buxar (T) Police Station Case No.250 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
