The petitioner seeks bail in a case registered for the offence under Sections 147, 148, 341, 323, 342, 307, 302, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, it is a case of assault upon the informant and his family members by the accused persons including the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. He next submits that similarly situated co-accused persons have been granted anticipatory bail by Co-ordinate

Patna High Court CR. MISC. No.35784 of 2024(2) dt.20-05-2024 2/3 Benches of this Court passed in Cr. Misc. Nos. 17533 of 2019 and 6356 of 2019, petitioner is in custody since 30.03.2024. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Kusheshwarsthan P.S. Case No. 148 of 2018 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Biraul (Darbhanga) with following conditions:- (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (iv) The petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his
