The State of Bihar & Ors. Therein Shri Piyush Kamal Dixit, District and Sessions Judge (Retired) had been appointed as the learned Arbitrator to adjudicate the disputes between the parties to the lis.

2. Learned counsel for the parties submit that the said learned Arbitrator has been appointed as the Chairman, District

Patna High Court MJC No.1396 of 2023(3) dt.13-10-2023 2/2 Consumer Forum, Vaishali. As such, he is not in a position to conduct the arbitral proceedings.

3. Hence, with the consent of the parties, Shri Kishore Prasad, District and Sessions Judge (Retired) is appointed as the Arbitrator in the present case and the very same terms of the order dated 01.02.2023 would apply also.
