Heard Mr. Kripa Nand Jha, learned counsel for the petitioner; Ms. Shilpa Singh, learned GA 12 along with Mr. Ram Vinay Prasad Singh, learned AC to GA 12 for the State; Mr. Shashi Bhushan Singh, learned counsel for the respondent no. 3 and Mr. Satyendra Kumar Jha, learned counsel for the Accountant General.

3. It is not in dispute that due payments to the petitioner have been made except for MACP which has been denied by the respondents.

4. Learned counsel for the petitioner submitted that the matter be disposed off with liberty to him to move before the Competent Authority with regard to grant of MACP benefit to him.

5. In view thereof, the writ petition stands disposed off with liberty aforesaid.

6. If the petitioner makes a representation for grant of MACP within four weeks from today, before the Competent Authority, the same shall be disposed off, in accordance with law, and a reasoned order shall be passed within four weeks from the date of filing of such representation.

7. If it is found that the petitioner is entitled to any further payment, the same shall also be paid to him within six weeks from the date of passing of the order.
