The petitioner apprehends his arrest in Bhagwan Bazar P.S. Case No.185 of 2020 registered under Sections 341, 323, 354, 354D, 504 and 506 of the Indian Penal Code. The victim alleged that she is a student of 12th class and she used to go to take tuition but the petitioner eve-teased her. The petitioner used to call her while she was in her house. When on disclosure made by the victim the mother of the victim went to the house of the petitioner, the petitioner assaulted her and threatened that no action will be taken against him. The learned counsel for the petitioner submits that the petitioner was having love affairs with the victim and they were on talking term. The occurrence is said to have taken place

Patna High Court CR. MISC. No.30869 of 2020(3) dt.19-01-2021 2/2 during the lockdown period. No date of occurrence is mentioned in the F.I.R. but it appears that victim made categorical statement that the petitioner used to continuously eve-teased her while she was going to take tuition and when she disclosed the fact to her mother and her mother went to complain, the petitioner assaulted her mother. The call detail report has also been obtained and it transpired that the petitioner used to call the victim.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
