JUSTICE VIKASH JAIN ORAL ORDER 15-01-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner has filed an undertaking to remove all defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.

2. The petitioner apprehends his arrest for the offences alleged under Sections 406 and 420 of the Indian Penal Code registered in connection with University (M.L.N.U.) P.S. Case No. 244 of 2019.

3. It is submitted that the petitioner has been falsely implicated in connection with alleged irregularity committed by him in execution of a scheme for beautification of the pond of

Patna High Court CR. MISC. No.30631 of 2020(2) dt.15-01-2021 2/3 Sarveshwarnath Temple situated in Ward No. 5 Darbhanga Municipal Corporation, Darbhanga. It is submitted that the work had been completed by the petitioner but subsequently some damage was caused to the Ghat and P.C.C. road. The petitioner categorically states on the basis of paragraphs 16 and 23 of the petition that the damaged portion has since been reconstructed, which has been acknowledged by the Executive Engineer in his letter dated 23.01.2020 (Annexure-4). It is therefore submitted that the allegations are not made out against the petitioner, and claims clean antecedents.

4. Learned APP appears and has been heard.

5. Be that as it may, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 4th, Darbhanga in connection with University (M.L.N.U.) P.S. Case No. 244 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C., if he is not otherwise required in any other case.

6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para-1
