2. The petitioners apprehend their arrest in connection with Triveniganj P.S. Case No. 87 of 2020 instituted under Sections 341, 323, 325, 308, 448, 354-B and 380/34 of the Indian Penal Code.
3. The allegation against the petitioners is that they
Patna High Court CR. MISC. No.34537 of 2023(2) dt.21-07-2023 2/3 along with 9-10 unknown persons have abused and assaulted the informant and his family members including his pregnant daughter due to land dispute.
4. Learned counsel for the petitioners submits that the petitioners and the informant are members of the same family and a land dispute is going on between the parties since long. The petitioners were not involved in the alleged occurrence and due to land dispute, they have been falsely implicated in this case. The allegation against the petitioners are general and omnibus in nature and no significant injury has been found on the injured. Learned counsel further submits that the petitioners have got no criminal antecedent.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Triveniganj P.S. Case No. 87 of 2020, subject to the conditions
