JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-11-2020 Heard learned counsel for the petitioners and the State. The petitioners are in custody in connection with Harnaut P.S. Case No. 175 of 2020 for the offence under Sections 147, 148, 149, 307, 323, 324, 325, 326 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent. He further submits that from perusal of the F.I.R., the allegation against these petitioners is only the member of the mob and there is no overt act alleged against these petitioners, much less firing. The petitioners are in custody since 24.05.2020.
