29-10-2021 Heard learned counsel for the petitioners, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant through video conferencing. Petitioners pray for grant of bail in Chhauradano P.S. Case No. 79 of 2021, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the prosecution case, all the three petitioners are alleged to have assaulted the mother of the informant by stick and iron rod.

It is submitted on behalf of petitioners that though, there is allegation of assault against these petitioners, but neither

Patna High Court CR. MISC. No.42515 of 2021(2) dt.29-10-2021 2/2 any injury report has been brought on record nor there is any reference in the impugned order. Petitioners are ladies and they are in custody since 03.03.2021. Chargesheet has been submitted.

However, Learned counsel for the informant vehemently opposed the bail application and submitted that there is specific allegation of assault against these petitioners. Considering the nature of allegation, period of custody, clean antecedent and the fact that petitioners are ladies, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Chhauradano P.S. Case No. 79 of 2021.
