The sole petitioner, apprehending his arrest in connection with Case No. 397C2 of 2013, registered for the offence under Sections 41, 42 and 02 of the Indian Forest Act, 1927 (Bihar Amendment 1989 ) has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner submits that petitioner has falsely been made accused and this is first case in which he has been arrayed as accused. He has also drawn my attention to the statement made in paragraph -3 of the petition to show that petitioner is having clean antecedent.
Patna High Court Cr.Misc. No.58611 of 2018(2) dt.20-09-2018 2/2 Sri Shailendra Kumar Singh, learned Additional Public Prosecutor has opposed the prayer for grant of anticipatory bail.
Considering the facts and circumstances, nature of accusation as well as clean antecedent of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let petitioner - Ramgit Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - Ist, Jamui / concerned court in connection with Case No. - 397C2 of 2013 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
