This application for regular bail arises out of Khaira P.S. Case No. 310 of 2020, disclosing offence punishable under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is in custody since 04.02.2021. The F.I.R. was registered against unknown persons with the allegation that the victim was shot at by the miscreants. The petitioner was subsequently apprehended and allegedly his confessional statement was recorded before the police to the effect that co-accused Nag Narayan Sharma had, out of mis-

Learned counsel for the petitioner has submitted that there is no material to suggest that the petitioner had opened fire.

Considering the aforesaid submission and the fact that the petitioner is in custody since 04.02.2021, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount, each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in Khaira P.S. Case No. 310 of 2020.
