The petitioner apprehend his arrest in connection with Sitamarhi P.S. Case No. 1123 of 2018 for the offence punishable under Sections 272 and 273 of the Indian Penal Code and 30(A) of Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from an abandoned place which is evident from the seizure list. The petitioner has no concern with the alleged recovery.

Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II -cumSpecial Judge, Excise Act, Sitamarhi in connection with Sitamarhi P.S.
