====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Parbatta (Maraiya) P.S. Case No. 229 of 2018, instituted for the offence under Section(s) 376, 511, 504 and 506/34 of the Indian Penal Code. Counsel for the petitioner submits that occurrence is said to have taken place on 23.6.2018 and the instant First Information Report has been lodged after three days of the occurrence i.e. on 26.06.2018. The petitioner and informant are neighbours. The instant case has been filed to compel the petitioner to perform marriage with elder daughter of the informant. He further submits that petitioner after entering into the room of informant tried to commit rape with elder daughter of informant namely, Rahima Khatoon.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Khagaria, in connection with Parbatta (Maraiya) P.S. Case No. 229 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
