HONOURABLE MR JUSTICE RAJIV ROY ORAL ORDER 13-09-2023 On call, no one appears on behalf of the petitioner though Ms Aditi Sharma represents Opposite Party No 2. 2 Prayer is for the following reliefs:

"That this is an application for quashing the order dated 06.02.2016 passed in Sessions Trial No 82 of 2014 arising out of Bidupur PS Case No 137 of 2004, under Sections 365, 366A, 368 IPC and Section 27 of the Arms Act in which the petition filed under Section 227 Cr P C for discharge is rejected by the impugned order passed by the learned Additional Sessions Judge VIII, Vaishali."

3 At the outset, Ms Aditi Sharma informs that as per the information received in her office, the petitioner is no more. 4 As per the affidavit, the petitioner was aged 80

Patna High Court CR. MISC. No.18679 of 2016(3) dt.13-09-2023 2/2 years in 2016 when the petition was preferred. 5 In view of the said submission put forward by the learned counsel for Opposite Party No 2, this petition has now become infructuous.
