The petitioners apprehend their arrest in Shahpur Patory P.S. case No. 414 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code pending in the Court of learned A.C.J.M.-IV, Samastipur. Petitioners in association of other co-accused are said to have killed the informant's daughter by strangulating her.
It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. The
Patna High Court CR. MISC. No.41506 of 2021(3) dt.20-06-2022 2/2 allegation levelled against the petitioners is not specific rather general and omnibus in nature. It is further submitted that the deceased had committed suicide and on mere suspicion they have been dragged in this case. It is also submitted that one coaccused Praveen Kumar who was facing trial has already been acquitted by the learned Court below. Petitioners have no criminal antecedent.
Per contra, learned APP for the State vehemently opposing the bail petition submitted that the allegations levelled against the petitioners is serious in nature, hence they do not deserve anticipatory bail.
Considering the facts and circumstances of case, I am not inclined to enlarge the petitioners on anticipatory bail. The prayer for bail of the petitioners is hereby rejected. (Anjani Kumar Sharan, J) Trivedi/- U T
