JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-06-2020 Heard Mr. Sanjay Kumar Verma, learned counsel appearing for the petitioner, Mr. Arvind Ujjwal, learned S.C. 4 for the State, as well as Mr. Satyendra Kumar Jha, learned counsel for Accountant General, through video conferencing. The grievance of the petitioner is that after his retirement, only 90% provisional pension till February, 2016 was paid to him.

The second supplementary counter affidavit has been filed on behalf of the respondents and in paragraph 19 of the aforesaid second supplementary counter affidavit, it has been averred that the full pension of the petitioner shall be paid

Patna High Court CWJC No.6004 of 2017(10) dt.30-06-2020 2/2 within three weeks in the light of the order dated 9.6.2020 passed by this Court.

In view of the aforesaid facts and circumstances as well as assurance given by respondents in paragraph 19 of second supplementary counter affidavit, this writ petition stands disposed of directing the respondents to ensure the payment of all retiral dues including full pension and arrears of the petitioner within four weeks from today, failing which the petitioner shall be at liberty to move for contempt before this Court.
