====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-01-2021 Heard learned counsel for the petitioners and State. The petitioners are in custody in connection with S.C. No. 215 of 2019, arising out of Harin Mar P.S. Case No. 3 of 2019, for the offence under Sections 304(B)/201/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The petitioners are the father-in-law and mother-inlaw of the deceased. Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and the petitioner no. 1 is in custody since 25.03.2019 and petitioner no.2 is in custody since 01.07.2019. He further submits that the petitioners are living separately with the husband of the deceased after few

Considering the aforesaid, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Munger in connection with S.C. No. 215 of 2019, arising out of Harin Mar P.S. Case No. 3 of 2019.

The court below shall verify the positive material that the petitioners are residing separately from the victim and her husband since 2017 i.e. after few months of the marriage of the victim with the son of the petitioners.

In the event the aforesaid facts are not established to the satisfaction of the court below, the court below shall not release the petitioners on bail.
