2. The petitioner is in custody in connection with Bachhwara P.S. Case No. 391 of 2024 for the offence punishable under Sections 191(2), 191(3), 190, 127(1), 115(2), 109, 303(2), 308(3), 352 and 351(2) of the Bharatiya Nyaya Sanhita, lodged on 20.11.2024 by the informant Chandan Kumar Yadav.

As per the prosecution story, the informant alleged that the accused persons armed variously came to his door and later after abuse, allegation is that Dinesh Rai and Karu Rai gave iron rod blow to brother Arvind Rai causing injuries, they also resorted to taking away some money, the injured was shifted to Primary Health Centre, Bachhwara and then to the
Patna High Court CR. MISC. No.30769 of 2025(3) dt.06-08-2025 2/2 Sadar Hospital, Begusarai.
4. In this case, the coordinate Bench had called for the case diary and injury report which are on record.
5. Learned counsel for the petitioner submits that they are agnates, the land dispute is there and he is in custody since 03.03.2025.
6. Learned counsel representing the informant on the other hand taken this Court to the injury report to show that the injury report of the Arvind Rai has been found to be grievous on head.
7. Taking into account the aforesaid facts as also the injury that Arvind Rai had suffered from the hands of the petitioner, for the present, no relief can be granted.
8. Accordingly, the bail application stands rejected. (Rajiv Roy, J) vinayak/- U T
