JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-08-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Though the present writ petition has been filed for quashing of the order dated 25.05.2017 passed by the Licensing Authority-cum-Sub-Divisional Officer, Bagaha, whereby and whereunder the license of the PDS shop of the petitioner bearing License No. 3 of 2007 has been cancelled as also for quashing

Patna High Court CWJC No.12889 of 2019(4) dt.03-08-2021 2/2 the order dated 02.04.2019 passed by the District Magistrate, West Champaran, Bettiah in Case No. CRM-61/2017-18, whereby and whereunder the appeal of the petitioner has been dismissed but since the petitioner has been served with a copy of the enquiry report dated 03.05.2017 by way of enclosure to the supplementary counter affidavit filed in the present case, the learned counsel for the petitioner seeks liberty to file a revision petition before the Revisional Authority as provided for under Rule 32(vi) of the Bihar Targeted Public Distribution System (Control) Order, 2016.

Accordingly, the present writ petition stands disposed off with liberty to the petitioner to file appropriate revision petition before the Revisional Authority and in case such a revision petition is filed within a period of four weeks from today, the Revisional Authority shall consider the same on merits, without being impeded by the issue of limitation and shall disposed off the same within a period of eight weeks thereafter, by a reasoned and speaking order, in accordance with law.
