The petitioners apprehend their arrest in Kawakole
Patna High Court CR. MISC. No.31275 of 2019(2) dt.10-05-2019 2/3 P.S. Case No.75 of 2017 registered under Sections 147, 149, 152, 341, 323, 353, 504 of the Indian Penal Code. The informant, a police officer, disclosed that he got information that members of two community had assembled and they were pelting stone on each other. The informant and other police officials reached on the spot and kept the situation under control. The informant further disclosed that after pacifying the matter the informant came to know that the petitioners and others belonging to both community had assembled and pelting stones on each other.
The learned counsel for the petitioners submits that no person of either side got any injury. All the offences are bailable save and except Section 353 I.P.C. The petitioners did not put any hindrance to any police official for discharging their duty. Taking into consideration the facts aforesaid and nature of allegation made against the petitioners and the fact that although there is allegation that members of both community pelted stones on each other but nobody was injured, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each
