JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-02-2023 Though the present writ petition has been filed seeking removal of encroachment from the public land situated at village-Sharma, PS-Ghoshi, District-Jehanabad, appertaining to Khata no. 161, Plot no. 1177, 1178 which is a Gairmazarua Aam land, however, it has been submitted by the learned

Patna High Court CWJC No.18518 of 2013(3) dt.17-02-2023 2/2 counsel for the parties that an encroachment case bearing Encroachment case no. 03 of 2013-14 has already been initiated by the Circle Officer, Hulasganj, Jehanabad, hence, the same be directed to be disposed off, in accordance with law, if not already disposed off.

Having regard to the aforesaid facts and circumstances of the case, I deem it fit and appropriate to direct the Circle Officer, Hulasganj, Jehanabad to pass the final orders under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in connection with Encroachment case no. 03 of 2013-14, in case the same has not already been passed, after hearing the affected parties and in accordance with law, within a period of 06 weeks of receipt/ production of a copy of this order. The writ petition stands disposed off on the aforesaid terms.
