====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the informant and the State.

The petitioner is in custody in connection with Bhagwanpur (Belaon) P.S. Case No. 89 of 2020 registered for the offences under Sections 302/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submits that there is no material against the petitioner and only on the basis of suspicion, the petitioner has been implicated in this case.

Learned counsel appearing on behalf of the informant would submits that there are definite

Patna High Court CR. MISC. No.30984 of 2020(3) dt.02-03-2021 2/2 evidences against the petitioner and while referring to the stage of the trial, he submits that out of six witnesses, four witnesses have been examined and the trial court may be directed to conclude the trial at the earliest.

In view of the above, this Court is not inclined to grant privilege of bail to the petitioner at the present. The prayer for bail of the petitioner stands rejected. However, the Court below is directed to expedite the trial and conclude the same at the earliest, preferably within a period of six months from today, failing which, the Court below shall release the petitioner on appropriate terms and conditions and submit failure report to the Registrar (Vigilance) of this Court. With the aforesaid observation/direction, the application stands rejected.
