The petitioner seeks bail in Tankuppa P.S. Case No. 13 of 2021, registered for the offence punishable under Sections 147, 148, 149, 427, 385, 504 and 506 of the Indian Penal Code and section 27 of the Arms.
As per the prosecution case, on 03.02.2021 in the morning while the informant was getting constructed his house, all the FIR named accused persons including petitioner came, threatened and demanded rangdari of Rs. 3 lakh and on refusal, in the night at 10.00 pm on the same day, the accused persons came and made indiscriminate firing and damaged his house. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Both parties are agnates. Admittedly there is land dispute between the parties
Patna High Court CR. MISC. No.41692 of 2021(2) dt.25-10-2021 2/2 and due to that petitioner along with others have been falsely implicated in this case. None has received injury in the alleged occurrence. Petitioner is in custody since 08.02.2021 having clean antecedent. Investigation is complete.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Gaya in connection with Tankuppa P.S. Case No. 13 of 2021.
