2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

3. The case of the prosecution is that the informant along with his helper parked the truck and slept near Sawan Dharm Kanta at about 10:30 PM, in the meantime, five accused persons entered into the truck started abusing and snatched mobile and Rs. 20,000/-. Thereafter, all the accused persons ran away with the truck.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the

During course of investigation, co-accused Manish Kumar and Guddu Kumar have given their confessional statement. The name of this petitioner has surfaced in their confessional statement. It has been submitted that nothing has been recovered from the possession of this petitioner. Moreover, the petitioner is languishing in judicial custody since 09.12.2024.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Amas P.S. Case No. 410 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sherghati, Gaya.
