The petitioners apprehend their arrest in connection with Ara Mufassil P.S. Case No.8 of 2024 registered for the offence under Sections 392 of the Indian Penal Code. 3.
The allegation against the petitioners is to have taken away mobile and Apache motorcycle of the informant on the point of pistol along with other unknown coaccused persons. 4.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.40024 of 2024(2) dt.16-07-2024 2/3 petitioners submits that petition has falsely been implicated with the present case, where, petitioners are not named in the FIR and their name surfaced during course of investigation on the basis of confessional statement of other co-accused person, namely, Biashal Kumar, who has already been granted regular bail by this Court through Cr. Misc. No.28093 of 2024 on 23.04.2024. It is submitted that mobile and motorcycle has been recovered from the possession of other co-accused, namely, Bishal Kumar and nothing has been recovered from the conscious physical possession of this petitioners. It is also submitted that the petitioners are man of clean antecedent. 5.
Learned APP appearing on behalf of the State, opposes the prayer of bail of the petitioners. 6.
Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioners, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the trial court within a period of six weeks from today on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, 7th Bhojpur at Ara, in connection with Ara Mufassil P.S. Case No.8 of 2024 subject to the condition laid
