The petitioner apprehends his arrest in Arer P.S. Case No.09 of 2021, registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code. The petitioner is said to have kidnapped the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the statement of the victim has been recorded under Section 164 Cr.P.C. in which the victim has stated that she solemnized marriage with the petitioner. The petitioner has got no criminal antecedent as stated in para-3 of the bail application.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Benipatti (Madhubani) in connection with Arer P.S. Case No.09 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
