This is an application for quashing of the order dated 10.9.2015 passed by the learned Judicial Magistrate, Danapur in Naubatpur P.S. Case No. 35 of 2015 whereby and whereunder cognizance was taken under Section 409 of the Indian Penal Code.

The petitioner was a Clerk in the Office of Circle Officer, Naubatpur who is the informant in the present case and the allegation is that the records of Land Settlement Case No. 05 of 2001-02 were not found in the Office which was needed in connection with the order dated 31.1.2015 of the Patna High Court and then it came to notice that the said work was allotted to the petitioner herein. He was put on notice and as he refused to receive the same, the FIR.

Patna High Court CR. MISC. No.47794 of 2015(3) dt.16-03-2023 2/2 In the aforesaid background, the learned Court took cognizance under Section 409 of the Indian Penal Code on 10.9.2015.

No case of interference is required.
