2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 310(2) of B.N.S.

3. The case of the prosecution, in short, is that unknown miscreants have committed loot at the shop of the informant. It is further alleged that this loot was made at gun point and ultimately, the accused persons fled away on two bikes. One was white colour Apache and other was black colour Hondashine.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced on the basis of information of the spy. Thereafter, confessional statement of this petitioner was recorded. It has further been submitted that from perusal of the seizure list, it will transpire that a white colour Apache bike was recovered from the possesion of this petitioner which is said to be used in the offence. It has further been submitted that in entire interrogation, it has not come as to anybody has disclosed the registration number of this bike. It is only stated that a white colour Apache bike was recovered. It has furthr been submitted this Apache bike belongs to him and his mother is the owner of that bike.

It has further been submitted that during course of investigation, it has also come that the informant has identified the petitioner and others at police station. It has further been submitted that the I.O. of this case has not conducted any T.I.P. rather the identification has been made in the P.S. itself. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 24.10.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is

The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Benipatti, Madhubani in connection with Arer P.S. Case No. 201 of 2025.
