1. Heard learned counsel for the parties.

2. The petitioner in the instant application has challenged the order dated 5.12.2012 passed in Appeal no.73 of 2010 by the District Teacher's Employment Appellate Authority, Katihar.

3. Learned counsel for the State submits that the

Patna High Court CWJC No.20956 of 2013(7) dt.02-11-2023 2/2 petitioner has an alternate and efficacious remedy of preferring an appeal against the order impugned before the State Appellate Authority (Education).

4. The application is disposed of giving liberty to the petitioner to challenge the order impugned by filing an appeal before the State Appellate Authority (Education).

5. In case the appeal before the Authority is filed within a period of four weeks from today, the Authority concerned shall take into consideration the period for which the instant application was pending in this Court and proceed to decide the appeal on its merits.
