JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 08.10.2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bairiya P. S. case no. 131/2018 registered under sections 354B, 379 and other allied sections of the IPC. Petitioners are said to have assaulted the informant as well as one other by fists and slaps and also tried to outrage modesty of the informant and committed theft of her ornament.
Submission on behalf of the petitioners that it was the prosecution party who assaulted the petitioners and others for which Bairiya P. S. case no. 132/2018 was lodged
Patna High Court Cr.Misc. No.60513 of 2018 (2) dt.08-10-2018 and in retaliation to the aforesaid case, the informant lodged this case.
Considering the above stated submissions as well as taking into consideration that alleged occurrence is said to have taken place on account of grazing field by a she-goat and except sections 354B and 379 IPC, almost all sections are bail in nature, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran, Bettiah in Bairiya P. S. case no. 131/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
