Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Pakaridayal P.S. Case No. 260 of 2020, disclosing offence punishable under Section 414 of the Indian Penal Code. The petitioner is in custody since 18.11.2020. Learned counsel for the petitioner has submitted that the stolen motorcycle cannot be said to have been recovered from the petitioner's conscious possession. Considering the facts and circumstances and the nature of accusation, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount, each to the satisfaction of learned C.J.M., East Champaran, Motihari in Pakaridayal P.S. Case No. 260 of 2020.
