Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. The petitioner, who is in custody since 16.03.2021, seeks regular bail in connection with Nagar (Town) P.S. Case No. 214/2021, for the offences punishable under Sections 346, 367 and 120(B) of the Indian Penal Code and Sections 3,4,5 of Immoral Traffic Prevention Act, 1956.

The prosecution case, in brief, is that on secret information a raid was conducted in the house of Sharda Charan Mishra, where the petitioner was living as a tenant. She was apprehended along with other co-accused, namely, Sikandar

Patna High Court CR. MISC. No.41334 of 2021(4) dt.18-02-2022 2/3 Singh with whom some girls were staying, and he had forced them in immoral work.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated. She is aged about 70 years. She being tenant in the said house has been roped in the present case. The illegal act was conducted by one Sikandar Singh. Nothing incriminating material has been recovered from the rented room or from the possession of the petitioner. He further submits that one coaccused namely, Sikandar Singh @ Mukhiya Ji alongwith whom girls were found has already been enlarged on bail by a Coordinate Bench of this Court in Cr. Misc. No. 38116 of 2021 vide order dated 23.09.2021.

Learned APP for the State has opposed the prayer for grant of bail to the petitioner.

Considering the above mentioned facts and circumstances of the case and taking into consideration the period of custody of the petitioner, as well as, the age of petitioner who is a 70 years old lady, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.

(2) petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.

(4) If the petitioner is found involved in similar nature of offence, after his release on bail, the trial Court shall take steps to cancel his bail bonds.
