2. The petitioner has preferred this application for grant of regular bail in connection with Tekari (Panchanpur) P.S. Case No. 09 of 2023 dated 03.01.2023 registered for the offences punishable u/s 392 of the Indian Penal Code.

3. As per the prosecution case, three unknown miscreants boarded on a motorcycle intercepted the informant and snatched his mobile phone and motorcycle on the point of pistol and fled away. Thereafter, the informant chased the miscreants then they handed over his mobile phone and threatened him to go away otherwise they would shot him.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.34453 of 2024(2) dt.14-05-2024 2/3 that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner has surfaced in the present case on the basis of confessional statement made in Kinjar P.S. Case No. 03/23 by one Muskan Kumari and thereafter confessional statement of the petitioner was recorded while he was in custody in connection with Alipur P.S. Case No. 44/23 and except that there is no evidence against the petitioner about the involvement in the present case. The petitioner was not identified while he was put on T.I.P. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has ten criminal antecedents and he is on bail in all the cases as stated in para 3 of the bail petition. The petitioner is in custody since 06.12.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gaya in connection with Tekari (Panchanpur) P.S.
