JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Petitioner is languishing in custody since 09.11.2013 in a case registered for the offences punishable under Section 302 of the I.P.C.

It is claimed by the step brother of the petitioner that this petitioner slit the neck of his wife. It is submitted by learned counsel for the petitioner that step brother was on inimical term with the petitioner as a result he named the petitioner. Though petitioner was not present in the house as he works at Patna and other witnesses are hearsay witnesses. The victim had relationship with anti-social elements with whom she used to reside.

Considering the fact that accusation is direct and specific against the petitioner, this Court is not inclined to grant bail to the petitioner at present.

Patna High Court Cr.Misc. No.25124 of 2014 (4) dt.22-01-2015 2/2 Let learned Adhoc Additional Sessions Judge, 2nd, Samastipur expedite the trial of Sessions Trial No. 67 of 2014, arising out of Patory(Mohanpur) P.S. Case No. 380 of 2013.

Accordingly the application is dismissed.
