This application for anticipatory bail arises out of Bhagwanpur P.S. Case No. 23 of 2020, disclosing the offence under Sections 304-B/34 of the Indian Penal Code. Petitioner is father-in-law of the victim. The marriage of the victim with the petitioner's son was solemnized in January 2015. Allegedly, the victim was done to death on 04.02.2020 for non-fulfillment of demand of dowry. Learned counsel appearing on behalf of the petitioner has submitted that there is vague allegation of demand of dowry against all the family members of the husband of the deceased. Patna High Court CR. MISC. No.30803 of 2020(2) dt.08-01-2021 2/2 omnibus allegation against all the persons named in the FIR including this petitioner and there is no specific allegation against this petitioner of demand of dowry soon before the death of the victim, this application is allowed.

Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned ACJM-I, Vaishali at Hajipur, in Bhagwanpur P.S. Case No. 23 of 2020, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/ Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
