JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 10-02-2022 Heard the parties through video conferencing. The petitioners seek bail in anticipation of their arrest in connection with Naubatpur P.S. Case No. 148 of 2021 instituted for the offences under Sections 399 and 402 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act, 1959.

Taking into consideration that the petitioners were not fount in the footage of the close circuit television camera,

No.41104 of 2021(3) dt.10-02-2022 2/2 offence under Sections 399 and 402 of the Indian Penal Code prima facie not made out, I am inclined to grant benefit of anticipatory bail to the petitioners and in the event of arrest they shall be released on bail subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
