JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-06-2022 Though the present writ petition has been filed for directing the Respondent-State authorities not to create hindrance / obstruction in peaceful possession of the petitioner over shop situated at Khata No. 672, Plot No. 896/3504, Area-.1/2 dec. out of 1 dec., i.e. east to west-11 feet width & North to South-15 feet length, in Village/P.S.- Nardiganj, District-Nawada, however, during the interregnum period, it appears that the shop in question has been demolished and it is the stand of the Respondents that the reliance of the petitioner on the records of the revisional survey &
Patna High Court CWJC No.16300 of 2015(5) dt.28-06-2022 2/2 the order passed by the revenue authority, to contend that the petitioner is having right, title and interest over the shop / land in question is, not a conclusive proof. In such view of the matter, the learned counsel for the petitioner seeks liberty to approach the learned court below for declaration of his right, title and interest over the shop / land in question and also for seeking damages for illegal demolition of his shop.
Accordingly, the present writ petition stands disposed of as not pressed, however, with the aforesaid liberty.
